No Infraction system?

After trying to infract a member at my forums, I have found that there is no option to do that, I don't see anywhere that the system has been turned off, any help? Is it with the theme?

It's not actually enabled by default. Turn it on from Admin > Configuration > Core Features, it's under Warning System. (Press the power button, then press Save at the bottom. Then you can click on 'Warning System' to configure it, and you can issue warnings from the user's profile)
