Well - Logically, you can not require something that is not there - and if you decide to require an agreement, you should make sure you have one - IMHO.

maybe fall back to a fatal_error() if the file isn't found and the agreement is required? iDunno...

To be honest, since agreement.txt is included in both installs and large upgrades, this is hardly a bug - this is something a forum admin must cause himself, by deleting the file. And you shouldn't need to do that, since there is an easier setting just for it....
