Just a note for any developer reading this... it is illegal to claim copyright for a year later than when your code was last modified. That is, your copyright is invalid. You must not display the "current year" as the second year, but must have a hard-coded year. Thus, if your first public release was 2006 and your last update to the code was 2009, your copyright statement should say "2006 - 2009". If you update the code in 2010 (which I believe that 2.0RC4 was), you can change that to "2006 - 2010". Only when the code is updated in 2011 can the copyright statement say "2006 - 2011".

Copyright on the content (the posts) is another matter. To do it strictly within the letter of the law, you would have to track the year of the last change to the posts, and use that in its own copyright statement. That way, before the first post of 2011 is made, it would still show the content to be copyright through 2010. For a reasonably busy forum, in practical terms it is probably OK just to use the current year, as the last post won't be 2010 for long. I would suggest adding another copyright statement for the content of the forum. Of course, by the forum owner's explicitly claiming copyright over the posts, that brings up the question of who actually owns the content (with the follow-on of who is liable for libel, copyright infringement, illegal content, etc.). Your license with your users (agreement.txt) should spell out exactly who owns what, and who is legally responsible for content. You might want a copyright statement/disclaimer that simply says that all posts remain the property of their creators, and are copyright in the year that they were made. Lots of ways to handle this...

Why does anyone care? The only (or last) copyright year starts the clock counting down to the expiration of the copyright and the material going into the public domain. That's why the law is concerned with having an accurate and fixed last year of change. Of course, with one Mickey Mouse organization (Disney) buying another Mickey Mouse organization (the US Congress) every decade or so to extend the copyright period for another lifetime (so Mickey Mouse films literally never go out of copyright), it may be a moot point, but that's the reasoning.

To return to the original problem, if it's showing 2009 sometimes and 2010 other times, that's a puzzler. 2009 is far too long for any code or page to have been hanging around in cache. Is the version number still RC4 when it shows 2009? Maybe some mod is overriding the copyright statement in some situations? Maybe guests see the current year while signed-on members see a fixed year?

I don't understand what the big fuss is?  You are making it seem like it is a huge issue and it's not.

If it is showing for different people at different times, then there must be a mix in the language strings.  If there is a mix in the language strings that means you probably have more than one language installed on your board.  If it shows 2010 for guests but 2009 for you, then you are probably using a language that was not updated properly like it should have been by our translators or you did not upgrade the extra language packs when upgrading to 2.0 RC4.  So here are some questions to answer:

1) What languages do you have installed?
2) What language is set as the forum default (which is what guests would see)?
3) What is the language *you* have set in your profile for yourself?
4) If you have multiple languages, open up index.[language].php in your theme directory and do a search for $forum_copyright and check the year in the string.  Adjust as necessary.

(although I have visited your site and I can see that you are probably using English-UTF8 as your default language (as it is installed) and thus see this problem after logging in.  You need to download new language packs and upgrade them on your board, or just use plain English)
