how do i edit the TOS (terms of service) that a new member has to accept before being able to register

You need to go through the below steps.

- 'Admin'
- 'Registration' on the left
- 'Registration Agreement'

Try this:
Admin>Members>Registration>Registration Agreement... edit as desired.
