Maintenance mode - People still get in - bug or not?

Um...  I am working on my board, and I look, ans see this.. The board IS in maintenance mode as you can see from the picture..  HELP!!!!!  This is NOT good, nor acceptable... 

On a side note to this..  should be a KICK OFF button that will instantly disconnect any user from the site.

Although SMF is registering them as 'online'. They will be viewing your Maintenance Mode page.

Even though the areas they show up in keep changing???  That's what is confusing me.  I look, and they are in board index.  I refresh, they are in their messages.  i refresh, and they are in calendar..  ??

Can you provide a test account so we can login to confirm?
Users cannot be doing those things if the board is in maintenance mode!!
Download Settings.php via FTP (How do I use FTP? / What is FTP?)

Ensure that the variable $maintenance = 0 has it's value set to "1".
It should be
