Nothing is hidden. If they don't want it to happen, then they are free to not register. But ... I do not believe this even has to be agreed to. Do the Mods offered here at SMF to stop spammers by checking their IPs and emails against 3rd party databases tell the forum owner to make changes to the forum privacy agreement? I've never read that.

I don't agree myself, but it may be an EU thing. I do not tell anything of the sort in my reg agreement, but I also use httpBL/project honeypot and Stop Spammer.  I do not plan on advertising it to the world either. Of course, the spammers already have me on a "do not spam list" anyway, due to the fact that the top contributors list at SFS is available to the general public. I rank pretty highly on that list, so they do not want to try to spam me anyway.
