Is there any license or formal policy that applies to customizing or duplicating custom themes?  I have a forum that would like to duplicate a 1.1 theme in 2.1.  Don't know if it's even doable, but I'd be uncomfortable copying a mod author's work.  I've suggested they contact the original author and see if he's interested in doing it on paid basis, but don't think he's still active with themes.

There is no issue if it's for personal use and not distribution.
As for emailing them, they'd be more willing to allow you to take over or publish your port than work on it themselves. Most of them have moved on.

It would be done just for one forum, as were my other customizations, with credit to original author in copyright.  It's one of Bloc's themes, he's still around but hasn't posted in a while, and don't see his themes on theme site.

If you alter a theme or a mod for yourself, it's pretty much always fine.

If you alter a theme or a mod for someone else, it can depend on the license somewhat, but usually you are still fine as long as that someone else has legally acquired said theme or mod.

If you alter a theme or a mod to share or sell, it completely depends on the original license.

Bloc made all his old themes available on an open slather basis some time back. As long as you do a decent job of it, and give him credit for the original, he'll be cool with it. At the time he put them all under the BSD 2 clause licence, but he appears to have changed it to GPL 3.0. The repo is still up.

He's been using black22, which isn't on your list.  There are multiple versions in his 1.1.21 /Themes directory, but none of them are the same as this, which he tells me is the modified theme they were running.  Not a big deal, I'm not trying to duplicate the theme, just create a 2.1 responsive theme with the same basic colors and graphics.  Roughing it out here.  That's Twitch's Blue Evolution (it's not blue anymore).  I've done several customizations with it so it's familiar, coding is pretty clean, nice basic layout.
